The learned counsel for the plaintiff on instructions would submit that the plaintiff is willing to go for trial subject to strict timelines to be fixed by this Court. He would further submit that as and when the suit is ripe for trial, the plaintiff gives an undertaking that they shall not delay the trial and shall render their utmost cooperation.

2. The learned counsel for the defendant has also not raised any serious objection if strict timelines are fixed for completion of trial as undertaken by the plaintiff. The learned counsel for the defendant seeks a week's time to file written statement.

3. On filing of written statement, both the counsels submit that the respective parties will file affidavit of admission/denial of documents within a week's time thereafter along with draft issues. The said statement is recorded.

4. Since the parties are willing to go for trial as per the strict timelines to be fixed by this Court, interim injunction granted by this Court in this application is made absolute based on the undertaking given by the plaintiff that the plaintiff shall Page No.1/3

complete the trial as expeditiously as possible and shall render utmost cooperation. For the foregoing reasons, this application is allowed as prayed for. Any observation made by this Court while granting interim injunction in this application will not have any impact on the final outcome of the suit.
