Respondent Petition under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondent herein to consider the representation dated 22.09.2017 submitted by the petitioner for cancellation of the punishment of Postponement of Increment for 2 years with cumulative effect imposed by the Commandant, TSP XII Bn., in his proceedings in P.R.No.25/2012 dated 03.05.2012 in the light of the judgment in S.C.No.288/2013 dated 18.11.2015 and pass orders on merits and in accordance with law within a time frame as deem fit and proper by this Court.

By consent, this writ petition is taken up for final disposal at the admission stage itself.

2.The case of the petitioner is that the petitioner was issued with a charge memo and subsequent to the charge memo, he was imposed with punishment by the original authority, namely Commandant, Tamil Nadu Special Police XII Battalion, Manimuthar for postponement of next increment for two years with cumulative effect. Thereafter the petitioner preferred appeal before the Deputy Inspector General of Armed Police, which was rejected. Further he filed revision before the Director General of Police, which was also rejected on 07.02.2017. Thereafter he filed further revision before the respondent dated 22.09.2017, but the same has not been considered so far. Hence, the petitioner has filed the present petition.

3.Heard both sides.

4.The learned counsel for the petitioner submitted that it would suffice, if a direction is issued to the respondent to consider the petitioner's representation dated 22.09.2017 and pass orders, within a stipulated time fixed by this Court. 5.Though the petitioner has sought for a larger relief, this Court without going into the merits of the case, directs the respondent to consider the petitioner's representation dated 22.09.2017 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order.

6.With the above direction, this writ petition stands disposed of. No costs.
