The only objection raised in respect of this application is that the defendant has made substantial changes in the written statement, as originally filed, and served on learned counsel for the plaintiff. On instructions, learned counsel for the defendant submits that he will re-file the written statement which was served on learned counsel for the plaintiff and that delay may be condoned on that condition.

By considering the length of delay and the reasons set out to explain such delay, this application is allowed on condition that the defendant re-files the written statement, as originally filed and served on learned counsel for the plaintiff.
