The petitioner, who apprehends arrest at the hands of the respondent for the offences punishable under Section 123 of BNS r/w 24(1) of Cigarette and other 1 / 4
Tobacco Products Act, 2003, in Crime No.151 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that the accused supplied banned tobacco products, weighing 210 kilograms to the carriers for sale to the public. Hence, the case.
3. Learned counsel appearing for the petitioner submits that the carriers were granted bail by this Court on 14.08.2025. Hence, this petitioner may be granted anticipatory bail.
4. The Learned Government Advocate (Crl.Side) submits that the persons who were carrying the tobacco products and the person who supplied them in wholesale do not fall under same footing. Further, the carriers were arrested and later released on bail, whereas this petitioner is absconding.
5. In view of the above facts of the case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
