Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the 2nd respondent herein to correct the Caste of the petitioner as 'Agamudayar-Back Ward Class' instead of 'Adi Dravidar' in their Records and issued the Transfer Certificate containing the correct Community viz:- 'Agamudaiyar-Backward Class' particulars to him within a stipulated period. 1/5

The writ of mandamus has been instituted to direct the 2nd respondent herein to correct the Caste of the petitioner as 'AgamudayarBack Ward Class' instead of 'Adi Dravidar' in their Records and issued the Transfer Certificate containing the correct Community viz:- 'AgamudaiyarBackward Class' particulars to him within a stipulated period.

2. Mr.D.Ravichandran, learned Special Government Pleader appearing on behalf of the 1st respondent, would submit that the respondents in the present writ petition cannot consider the application submitted by the petitioner for change of caste in the transfer certificate.

3. The counter filed by the respondents would reveal that the petitioner has stated his community as 'Scheduled Cast' in all his 2/5

documents. The petitioner further availed a scholarship, which was exclusively reserved for the candidates belonging to the scheduled cast category. Now he has made an application stating that he does not belong to the Scheduled Caste Community. If so, the petitioner has to approach the competent Revenue Authority for the purpose of conducting inquiry.

4. However, the Director of Technical Education or the Principle of Polytechnics College cannot consider such application for the purpose of granting such relief. Thus, the petitioner is at liberty to approach the appropriate authority.

5. Accordingly, the Writ petition stands dismissed. No costs. (sha) 18.04.2024 Index : Yes Speaking Order 3/5
