Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 1st respondent to consider petitioner appeal dated 27.12.2023 and direct to give information which was sought by him (the 43 selected SC Candidates list) within a time frame fixed by the Court.

ORDER

This writ petition has been filed in the nature of mandamus seeking a direction to the 1st respondent, Commissioner of Tamil Nadu State Information Commission, Chennai to consider the appeal filed by the petitioner on 27.12.2023 and give the information which was sought.

2.In the affidavit filed in support of the writ petition, it had been stated that the petitioner had earlier filed W.P.No.22980 of 2023 and unfortunately for the petitioner, it was dismissed. Thereafter, the petitioner had addressed a letter dated 24.08.2023, under the Right to Information Act. A communication was received on 25.09.2023 from the 3rd respondent that he would not provide with any answer. The petitioner then filed an appeal before the 1st respondent on 27.12.2023. It is contended that no action had been taken. However that fact is wrong.

3.It is informed by the learned Standing Counsel that the second appeal had been numbered as S.A.No.21773/A/2023. The 1st respondent may take it up in accordance with the seniority of the pending cases and examine the credentials of the petitioner and pass appropriate orders.
