The Writ Petition (Criminal) has been filed seeking a direction to the third and the fourth respondents not to interfere with the petitioner's business carried on in the name and style of "JMJ Container Service and Yogi Enterprises".

The petitioner is running a container service in the name of "JMJ Container Service and Yogi Enterprises", at the rented premises situated at 2A, Elanthanur Perumal Koil Street, Sadaiyankuppam, Elanthanu, Manali Pudhunagar, Chennai, owned by Vallalar Mutt, Tiruvottiyur. It is stated that due to some dispute among the Trustees of the said Mutt, attempts were made by the seventh respondent to evict the petitioner from the premises. Further, based on the complaint given by the seventh respondent, respondents 3 and 4 have interfered with the 2/5
petitioner's business and attempted to evict him from the said premises. Hence, the present petition has been filed.

Learned Government Advocate (Criminal Side), on instructions, submitted that a CSR has been registered on the basis of the complaint given by the seventh respondent, the landlord, alleging that the petitioner, who is the tenant in the premises, has sublet the same to the third party and has also defaulted in the payment of rent.

Be that as it may, this Court is of the view that in such matters, the Police shall not interfere. The dispute between the landlord and tenant are civil in nature and it is open to the landlord to initiate appropriate proceedings before the competent forum for eviction of the tenant in accordance with law and not through the intervention of the Police.
5. In view of the above, this Writ Petition stands closed. No costs. Consequently, connected miscellaneous petition is closed 13.08.2025 ham 3/5
