The petitioner, who apprehends arrest at the hands of the respondent Police for the offences under Sections 24(1), 6(b) of Cigarette and other Tobacco Products Act, 2003 and Section 77 of the Juvenile Justice (Care and Protection of Children) Act in Crime No.511 of 2023 seeks anticipatory bail.

The learned counsel for the petitioner stated that the petitioner is an innocent person and he has been falsely implicated for the offences under Sections 24(1), 6(b) of Cigarette and other Tobacco Products Act, 2003 and Section 77 of the Juvenile Justice (Care and Protection of Children) Act in Crime No.511 of 2023. Thus, he seeks anticipatory bail to the petitioner.

3. It is stated by the learned Government Advocate (Crl.Side) submitted that during a regular vehicle surveillance, the respondent police had found a Ashok Leyland Dost No.TN 22 DH 1792 parked nearby a School at Ndukuppam to Akaththur Highway road. When a search was 1/3

conducted, it was found that the vehicle contained 7 kgs of banned tobacco products. The intention of the accused was to sell them to the school children. It is stated that A1 and A2 had been granted anticipatory bail. Thus, he prayed for dismissal of this petition.

4. It is stated that A1 and A2 had been granted anticipatory bail. A1 and A2 are only driver and cleaner of the lorry. However, the petitioner herein is the owner of the lorry, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 13.10.2023 gd 2/3
