PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the Judicial Magistrate III, Thirupathur to dispose in C.C.No.137 of 2020.

ORDER
The petitioner is a private complainant in C.C. No.137 of 2020 alleging that the learned Judicial Magistrate III, Thirupathur is not taking up the case, is before this Court seeking a direction to dispose this complaint in a time bound manner.

2. The case status reveals that though the petitioner attending the Court, he has not prepared to mount the witness box and therefore, the case has been adjourned. When, this case was called on 21.09.2023, the learned Judge has recorded as below, "the complainant present. A2 and A3 present. A1, A4 and A5 are absent. Petition filed and allowed. For complainant side evidence as last chance, call on 20.10.2023". Therefore, it clearly shows that the preparedness of the petitioner to mount the witness box is lacking.

In any event, since it is posted as a last chance for him to adduce evidence on 20.10.2023, complainant be present and on his presence, the learned Judicial Magistrate is directed to record his evidence and if any further witnesses, the complainant shall give list of witnesses and the date required for examining the witnesses. According to his request and convenience of the Court, dates for examination of witnesses be fixed and trial be completed preferably by the end of 31st of January, 2024.
