This writ petition has been filed for the issue of writ of mandamus directing the respondents to consider the representation made by the petitioner on 25.07.2024, wherein the petitioner is seeking for disbursement of the family pension.

2.Heard the learned counsel for the petitioner, learned Special Government Pleader for respondents 1 & 2, learned Standing Counsel for 3rd respondent and the learned Standing Counsel for the 4th respondent. 3.The case of the petitioner is that her husband was working as a Driver in the respondent Corporation. On 30.04.2017, he attained 2/5

superannuation after putting in 28 years of service. He was also paid the retirement benefits and was also receiving monthly pension. The petitioner's husband passed away on 21.09.2023, leaving behind the petitioner, three sons and three daughters. The grievance of the petitioner is that the petitioner was not paid the family pension after the demise of her husband, even though the petitioner has been nominated as the nominee to receive the benefits. The representation made by the petitioner in this regard also did not evoke any response. It is under these circumstances, the present writ petition came to be filed before this Court seeking for appropriate directions.

4.Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the respondents 2 & 3 to deal with the representation made by the petitioner on 25.07.2024 and take a final decision on its own merits and in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order.

5.Accordingly, this Writ Petition is disposed of with the above directions. No costs.
