PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to disburse the 60 days of Earned Leave Surrender amount of Rs.39,867/- with interest amount at the rate of 9% on the delayed payment from the respective accrual dates payable to the petitioner within the stipulated time.

The writ petition is filed for the below relief: "directing the respondent to disburse the 60 days of Earned Leave Surrender amount of Rs.39,867/- with interest amount at the rate of 9% on the delayed payment from the respective 1/4

accrual dates payable to the petitioner within the stipulated time."

2. The brief facts which has culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioner that he joined as a Conductor in Cheran Transport Corporation, which was later renamed as Tamil Nadu State Transport Corporation (CBE) Ltd under the Government of Tamil Nadu on 10.02.1988. After completion of 31 years of service, he attained the age of superannuation on 31.10.2019 at Coimbatore Region of the respondent. During his service, the petitioner had surrendered his Earned leave of 60 days for the years 2009 to 2012. It is his contention though his earned leave was debited, the same has not been encashed by the respondent inspite of his several requests. The petitioner had made a representation under Right to Information Act, 2005 dated 31.07.2021. In pursuance of the same, the respondent herein had admitted their liability towards surrender amount of Earned leave vide ref No.2831/P4/Paybill/TNSTC(CBE)/2021 dated 25.08.2021 to the tune of Rs.39,867/-.

2.2. The petitioner had made a representation dated 07.07.2025 to the 2/4

respondent, however, the same had not been considered. Therefore, the petitioner is before this Court.

3. Heard the learned Counsels on either side and perused the records.

4. Considering the facts and circumstances of the case, it is evidently clear that the petitioner is entitled to the amounts mentioned above. Therefore, a mandamus is issued directing the respondents to pay the admitted liability of Rs.39,867/- with 6% interest per annum instead of 9% per annum as claimed for the belated payment from the date of respective accrual within a period of one month from the date of receipt of a copy of this Order.

5. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
