Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents to take appropriate action to lay a tar road in a general pathway situated in S.No.89/18, 90/10 and 96/25 for access to the seventh respondent School based on the representation of the petitioner dated 23.08.2023.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.D.Ashok Kumar, learned counsel for the petitioner, Mr.P.Muthukumar, learned State Government Pleader assisted by Mrs.R.Anitha, learned Special Government Pleader for respondents 1 to 5 and Mr.M.Raja Sekhar, learned counsel for respondent 7.

2. The contention is that a cart-track exists, however, the same may be made as a tar road.

3. Learned counsel for the seventh respondent supports the request made by the petitioner and submits that the seventh respondent would also contribute if the Government lays a tar road.

4. The State Authorities may consider the said aspect. Representation is already given on 23.08.2023 to that effect. Appropriate Authorities shall consider the said representation and take a decision, in accordance with law, preferably within a period of four months.

5. Accordingly, the writ petition stands disposed of on its own merits. There will be no order as to costs.
