Respondents Prayer: Original Petition filed under Sections 3, 7, 10 and 29 of the Guardian and Wards Act, 1890 and Order 21 Rule 2 of the Original Side Rules praying for appointment of Guardian to the minor Shruthika, D/O.Mathiyazhagan, aged 13 years and Dhaksheshwar, D/O.Suresh Kumar aged 8 years and to permit the petitioner to receive the terminal benefits of the deceased on behalf of the minors and invest the same in the name of the minors in any Nationalized Bank and also seeking permission to withdraw the interest the sum of Rs.20,000/- a month may be fixed for the maintenance and education of the minors.

ORDER

On 07.09.2020, a Memo has been filed by the petitioner making the following submissions:

"It is submitted that in the above matter the petitioner withdraw the prayer mentioned at Paragraphs 2 and 3, ie., "(1).Permit the petitioner to receive the terminal benefits of the deceased on behalf of the minors and invest the same in the name of the minors in any Nationalised Bank and (2).Permit to withdraw the interest the sum of Rs.20,000/- a month may be fixed for the maintenance and education of the minor" in the interest of Justice and speedy disposal of the Original Petition.

It is further submitted that since the custody of the Minor Dhakseshwar, son of Suresh Kumar is with the 2nd respondent the petitioner has no objection for appointing 2nd respondent as guarding (sic) for Minor Dhakseshwar. 2/4

It is therefore prayed that this Hon'ble Court may be pleased to record the above submission and dispose of the Original Petition on the strength of prayer I mentioned in the Original petition and petitioner may be appointed as Guardians of the above named Minor Shruthika, D/O.Mathiazhagan alone and thus render Justice." The said Memo is taken on file and the Original Petition is disposed of. The petitioner is appointed the guardian of Minor Shruthika, D/o.Mathiazhagan and the 2nd respondent as guardian of Minor Dhakseshwar.
