The plaintiff presented this application to bring on record the legal heirs of the sole defendant, who passed away after the institution of the suit, and to implead them as defendants 2 to 5 in the suit.

2. On instructions, learned counsel for the defendant states that he has no objection to this application being allowed. Accordingly, A.No.5056 of 2022 is allowed as prayed for. Consequently, the plaintiff is directed to carry out the amendments on or before 05.01.2023 and serve a copy of the amended plaint on learned counsel for the defendant. As a corollary of the above, the defendant is also permitted to carry out necessary amendments in the written statement and counter claim filed by the defendant. This process shall be completed on or before 18.01.2023.

3. List the matter on 19.01.2023.
