The petitioner seeks anticipatory bail in Crime No.127 of 2022 registered by the respondent police for the offences punishable under Sections 20(b)(ii)(B) r/w 8(c) of NDPS Act, 1985 and Section 77 of J.J Act, 2015.

2. The case of the prosecution is that the petitioner along with other accused were found in possession of 1158 grams of ganja. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and based on the confession statement of the arrested accused, the petitioner has been implicated in this case. He further submitted that co-accused has been released on bail. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) for the

respondent stated that the petitioner along with other accused were found in possession of 1158 grams of kanja. He further stated that absconding charge sheet has been filed as against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the fact that an absconding charge sheet had been filed in Crime No127 of 2022 by the respondent police and the same has been taken cognizance by the III Additional District and Sessions Court, Puducherry, as Spl.S.C.No.94 of 2022 and Non-bailable Warrant is also pending against the petitioner herein, this Court is not inclined to grant anticipatory bail to the petitioner.
