The petitioner, who was arrested and remanded to judicial custody on 19.08.2023 for the offences punishable under Section 392 of Indian Penal Code @ 395 of Indian Penal Code in Crime No.327 of 2023 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the two unknown persons, who came in a Pulsar Ns 200 two wheeler snatched the chain from the defacto complainant while she was returning to her home in a Suzuki Avenis two wheeler bearing registration No.PYO1 CY 7620. The defacto complainant lodged a complaint and FIR has been registered in Crime No.327 of 2023 by the respondent police. During the course of investigation, the petitioner herein was arrested and remanded to judicial custody.

3.It is stated by the learned counsel for the petitioner that the petitioner is an innocent person and he was falsely implicated in this case. He further stated that the petitioner is a college student studying DME in Sri Krishna Polytechnic College, Dindigul. Thus, prayed for grant of bail to the petitioner.

Crl.O.P.No.23130 of 2023 mkn2/sli 4.The learned Government Advocate (Criminal Side) stated that there are three previous cases against the petitioner herein and A1, A2 and A3 are detained under Act 14 of 1982. Thus, he prayed for dismissal of the petition. 5.In view of these facts, I am not inclined to grant bail to the petitioner herein.
