Transfer Civil Miscellaneous Petition filed under Section 24 of the Civil Procedure Code, to withdraw I.D.O.P. No.421 of 2018 pending on the file of II Additional Judge, Nagercoil and transfer the same to the file of the Family Court, Chennai.

2. Learned counsel for the petitioner submitted that the respondent was served about the pendency of the proceedings before this court and that the respondent has entered appearance through counsel. When the matter is taken up for hearing, there is no representation for the respondent. Hence, this court is of the view that the respondent has no objection for transferring I.D.O.P. No.421 of 2018 pending on the file of II Additional Judge, Nagercoil to the file of Family Court, Chennai.

3. In view of the above, I.D.O.P. No.421 of 2018 pending on the file of II Additional Judge, Nagercoil, is withdrawn from the said court and transferred to the file of Family Court, Chennai. The Family Court, Chennai, is expected to conclude the trial, as expeditiously as possible, without adjourning the matter beyond 45 working days, at any point of time, in order to bring the issue to a logical end.

4. The Transfer Civil Miscellaneous Petition is allowed as indicated above. No costs. Consequently, the connected Civil Miscellaneous Petition is closed.
