ORDER

This Criminal Original Petition has been filed to direct the 1st respondent to transfer the investigation in Crime No.178 of 2022 pending on the file of the 2nd & 3rd respondents to the 4th respondent and investigate the same and to file the final report.

2.The learned counsel for the petitioner submitted that on 08.08.2022, when the petitioner went to the Temple for attending the feast, the accused one Poondi.Kalaivendhan and his gang had prevented the petitioner and created ruckus and also abused him using his caste name. Therefore, the petitioner had lodged a complaint before the third respondent. Based on the complaint, the third respondent registered a case in Crime No.178 of 2022 for the offences under Sections 294(b), 323, 324 of IPC r/w 3(1)(r), 3(1)(s), 3(2)(va) of Scheduled Caste and Scheduled Tribes Act on 11.08.2022. Thereafter, there is no progress in this case. Hence, the present petition has been filed. 2/4

3.The learned Government Advocate (crl.side) appearing for the respondents submitted that in this case, final report has been filed before the learned Special Court for SC/ST cases, Thiruvarur and the case has been taken up on file in Spl.S.C.No.75 of 2022 and further the Trial Court had issued summon to the accused for their appearance.
