The petitioner was arrested on 08.04.2025 for the offence under Sections 8 (c), 20 (b) (ii) (C) of NDPS Act, in Cr.No.52 of 2025. 1/5

2.The case of the prosecution is that the petitioner was found in illegal possession of 22 kgs of Ganja. Hence, the case. 3.The learned counsel for the petitioner states that the petitioner is an innocent person and has been falsely implicated in this case. He further submits that the petitioner has been in judicial custody from 08.04.2025. Hence, prays for grant of bail to the petitioner.

4.The learned Government Advocate (Criminal side) appearing for the respondent Police states that the petitioner hails from Odisha. On specific information, the petitioner was intercepted near the Bus Stand from his possession 22kgs of Ganja was seized. On completion of investigation, final report filed before the Special Court for NDPS Cases on 01.08.2025. If the petitioner is released on bail, there is every possibility of his abscondence. Hence, opposed for grant of bail to the petitioner.

5.Heard the learned counsels on either side and perused the materials available on record.

6.Considering the nature of the case and the quantity of contraband seized from the petitioner, this Court finds that the Twin conditions contemplated under Section 37 of the NDPS Act, 1985, stands against the petitioner. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
