Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the Third Respondent to take necessary action on the representation of the Petitioner, dated 28.05.2019 with the recommendation of the Second Respondent, Na.Ka. 135/A1/2019, dated 13.05.2019 under the provisions of the Tamil Nadu Maintenance and Welfare of Parents and Senior Citizens Rules, 2009.

The grievance sought to be ventilated by the Petitioner, who is a senior citizen, is that she had made an application before the Third Respondent under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, in which there has not been any progress after the enquiry held on 15.07.2019, and seeks direction for its expeditious disposal. https://hcservices.ecourts.gov.in/hcservices/

Mr. R. Venkatesh, Learned Government Advocate, who takes notice for the First to Third Respondents, on instructions, states that the next date of enquiry has been fixed on 28.11.2019 by the Third Respondent and that notice for the same would be issued in advance to all parties concerned. A memo has already been filed to that effect.

The Third Respondent shall ensure that there is atleast one effective hearing every week showing progress of the case and after affording full opportunity of hearing to all the parties concerned, shall consider each of their contentions and pass reasoned orders on merits and in accordance with law and communicate the decision taken to them under written acknowledgement.

The Writ Petition is disposed on the aforesaid terms. No costs.
