The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records relating to the communication vide No.543/PHB/EW-4/J.Nagar/2019/276 dated 05.09.2019 sent by the first respondent and quash the same and consequently direct the respondents to execute sale deed in favour of the petitioner's trust for the land measuring to an extent of 2,184 square feet comprised in R.S.Nos.143/89 pt (129 square feet) and 164/8 pt (2055 square feet) situated at Pondicherry Registration District, Oulgaret Sub Registration District, Oulgaret Municipal Limit, Village No.36, Reddiyarpalayam Revenue Village based on the 2/4
representation dated 14.08.2019 submitted by the petitioner. 2.The learned counsel appearing for the petitioner submitted that the petitioner has filed this writ petition challenging the communication dated 05.09.2019 in and by which the respondents demanded a sum of Rs.83,42,880/- for disposal of the subject property in favour of the petitioner. However, the subject property was surrendered to the respondents and the petitioner have no intention to purchase the property.
3.The subject land was surrendered to the respondents and the petitioner have no intention to purchase the property. The said submission made by the learned counsel appearing for the petitioner is recorded.
4.The writ petition is dismissed. However, if the respondents conduct any public auction in respect of the subject property, in future, liberty is granted to the petitioner to participate in the said public auction. No costs. Consequently, connected miscellaneous petitions are closed.
