The notice that was sent to the first respondent/claimant was refused to be received. Hence, the name of the first respondent is printed in the cause list. However, he does not choose to appear either in person or through a counsel.

2. This civil miscellaneous petition has been filed seeking to condone the delay of 159 days in filing the main civil miscellaneous appeal.

3. Heard the learned counsel for the petitioner and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the civil miscellaneous petition is allowed and the delay of 159 days is condoned.

5. Registry is directed to number the main civil miscellaneous appeal and list the same for admission.
