The petitioners herein seek bail in Crime No.407 of 2023 on the file of the respondent police for the offence under Sections 294(b), 506(i), 306 of IPC r/w.511 IPC @ 294(b), 506(i), 306 IPC r/w.Sec.4 of TamilNadu Prohibition of Charging of Exorbitant Interest Act.

2. The learned counsel for the petitioners submitted that, petitioners are innocent and they have been falsely implicated in this case as 1st and 2nd accused in Crime No.407 of 2023 registered for the offence under Sections 294(b), 506(i), 306 of IPC r/w.511 IPC @ 294(b), 506(i), 306 IPC r/w. Sec.4 of TamilNadu Prohibition of Charging of Exorbitant Interest Act. Thus, he seeks grant of bail to the petitioners.

The learned Government Advocate (Criminal side) opposed this petition by stating that defacto complainant had obtained loan for a sum of Rs.1,00,000/- (Rupees one lakh only) from the Accused No.1 and was paying interest. But due to corona period, he could not pay the interest. Therefore, the Accused No.1 and 2 had demanded return of money and also threatened 1/3

him. Therefore, the defacto-complainant and his wife consumed pesticide to commit suicide. Though they were initially admitted to hospital and first information report was registered and subsequently, they died.

4. Due to the act of the petitioners, defacto complainant and his family has been wiped out. In view of the circumstances stated, this Court is not inclined to grant bail to the petitioners. Therefore, these Criminal Original Petitions are dismissed.
