The petitioner has filed this Writ petition seeking direction to the respondents to issue original sale Deed in favour of the petitioner in respect of the subject property, by considering the petitioner's representation dated 21.04.2023.
2. Mr.D.Veerasekaran, learned counsel takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, this petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that the plot bearing No.J 53, Kambar Street, Jaffarkhanpet, Chennai originally belongs to the Tamil Nadu Housing Board and the same was subsequently allotted in favour of the petitioner on 15.07.1978 and the petitioner took possession of the said plot on 26.07.1978 and she also constructed a building in the said plot. While so, though, the petitioner paid all the dues and though the Housing board issued 'No Page No.2 of 6
Objection' on 24.10.2005, till date, the housing board has not issued original sale deed in the name of the petitioner in respect of the said property. Thereby, the petitioner made several representations before the respondent Housing board seeking issuance of sale deed in favour of the petitioner and last representation made by the petitioner was on 21.04.2023. However, till date, no orders have been passed on the said representations. Hence, this Writ petition.
4. Though very many grounds have been raised, the learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the respondents to consider the petitioner's representation dated 21.04.2023 and to consequently, issue original sale Deed in favour of the petitioner in respect of the subject property, as expeditiously as possible.
5. Learned counsel appearing on behalf of the respondents submitted that, appropriate orders will be passed on the petitioner's representation dated 21.04.2023 within the time stipulated by this Court. Page No.3 of 6
6. In view of the aforesaid submissions, this Court without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 21.04.2023 on merits and in accordance with law and pass appropriate orders within a period of two (2) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner.
7. With the above directions, this Writ Petition stands disposed of. No costs.
