Application No. 7831 of 2019 in Civil Suit No. 363 of 1912 --- R. SUBBIAH, J -- The Official Trustee of Tamil Nadu has filed this application praying to permit him to spend a sum of Rs.4,000/- to Rs.5,000/- towards feeding 50 poor persons at Ponnambalam Pillai Choultry, Mylapore, on every Amavasai day. 2.

According to the learned Official Trustee, by order dated 12.03.2010 in Application No. 1420 of 2010, this Court permitted him to spend a sum of Rs.1,500/- for feeding 50 persons on every Amavasai day and accordingly 50 persons are being fed till this date. It is his contention that the prices of food items and other allied items required for feeding 50 persons has escalated and the amount of Rs.1,500/- permitted to be spent by this Court in the order dated 12.03.2010 is grossly insufficient to fulfil the obligation to serve food. He would further state that if the variety food packets are served by calculating one pocket at Rs.75/- per head, it would work out to Rs.3,750/-. It is further stated that food has to be served along with a mini water bottle, which is required while taking food and in such event, he may be permitted to spend Rs.4,000/- to Rs.5,000/- for feeding 50 persons at Ponnambalam Pillai Choultry, Mylapore, on every Amavasai day. 3.

I have considered the submissions of the learned Official Trustee and perused the records. It is no doubt true that the prices of the food items have increased and it is not possible for the Official Trustee to serve food for 50 persons 1/3

by spending only a sum of Rs.1,500/-. Therefore, I am of the view that the request of the learned Official Trustee to permit him to spend more amount is wholly justified.

Having regard to the submission of the learned Official Trustee and taking note of the escalation of the price in food items, I am of the view that the Official Trustee can be permitted to spend a sum of Rs.4,000/- to feed 50 poor persons at Ponnambalam Pillai Choultry, Mylapore on every Amavasai day. Accordingly, this application is ordered permitting the learned Official Trustee to spend a sum of Rs.4,000/- to feed 50 persons. 18-10-2019 rsh 2/3
