This petition has been filed seeking to condone the delay of 223 days in filing the restoration application in the above second appeal.

2.Mr.Akhil Ahmed Akbar Ali, learned counsel for the first respondent submitted he has no objection in allowing this petition. Despite notice being served to the second respondent and name being printed in the cause title, there is no representation for the second respondent.

3. Considering the facts and circumstances of the case, being satisfied with the reasons stated in the affidavit filed in support of this petition and in order to give fair opportunities to the parties to contest the appeal on merits, this petition is ordered, accordingly.
