This petition has been filed to relax the condition imposed on the petitioner to report before the trial Court, learned XIV Additional Special Judge for CBI Cases, FAC-XII Additional Special Judge for CBI Cases, Chennai once in three months on the first working day of January, March, June, September and December at 10.30 a.m. until further orders in Crl.M.P.No.3023 of 2020 in Crl.A.No.163 of 2020 dated 19.03.2020.
2. The petitioner seeks relaxation of the condition. The condition was imposed in the year 2020 directing the petitioner to appear before the trial Court once in three months on the first working day of January, March, June, September and December at 10.30 a.m. until further orders. Learned counsel for the petitioner submitted that the petitioner has been regularly appearing before the trial Court without fail. The petitioner is a native of Haryana and is residing at his native place and earning his livelihood in his native place. The petitioner is suffering from severe lower back pain and unable to sit for long hours. Due to financial constraints and heath issues, he is unable to travel. Page 1/3
Learned counsel on instructions further submitted that the petitioner will not be reason for the delay or seek adjournment, when the appeal is taken up for final hearing. Hence, he prays to relax the condition imposed on 19.03.2020.
5. Learned Special Public Prosecutor appearing for the respondent submitted that the petitioner is complying with the condition without any deviation.
6. Considering the facts and circumstances of the case and also considering the submission made by the learned Special Public Prosecutor that the petitioner is complying with the condition without any deviation, the condition imposed on the petitioner to report before the trial Court, is totally relaxed.
