This writ petition has been filed to direct the 2nd respondent to consider the petitioner's application dated 05.08.2025 for grant of permission to celebrate festival and provide police protection to celebrate Parukkal Village Arulmigu Sri Muthumariamman Thirukoil "Palkuda Thiruvizha" scheduled to be held between 15.08.2025 to 17.08.2025 in a peaceful and religious manner.
2.Learned Government Advocate (Crl. Side), on instructions, would submit that the rival group has also applied for permission for conducting
festival on the same day and same time. He would further submit on instructions that, if both the groups are allowed to go together into the temple for conducting the festival, it will certainly lead to law and order problem. He would further suggest that both the groups can appear before the Deputy Superintendent of Police for an amicable solution. 3.In view of the above, the representatives of both the groups are directed to appear before the Deputy Superintendent of Police today evening between 05.00 p.m. and 06.00 p.m. If the Deputy Superintendent of Police decides to give permission to one group, he shall ensure that permission is given to the other rival group also, but on a different timing. It is made clear that the Police shall not take sides in granting permission to a particular group alone.
If only one group is allowed, it will only be a discrimination. If both the groups are not agreeable to the timings and if the Police so feels that it would create a law and order by letting in two groups at a same time into the Temple, let permission not be given to any group. If advised, let the parties agitate their rights over the temple before the Civil Court in the manner known to law.
