Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus forbearing the 1st respondent from registering any document in respect of the petitioner's land situated in S.Nos.523/3 and 522/2, Ugayanur Village, Tiruppur South Taluk, Tiruppur District to the extent of 1.25 Acres.

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass in this writ petition, notice to 2nd respondent is dispensed with.

The relief sought in this writ petition is to forbear the 1st respondent from registering any document in respect of the petitioner's land comprised in S.Nos.523/3 & 522/2, measuring an extent of 1.25 Acres, situated at Ugayanur Village, Tiruppur South Taluk, Tiruppur District (hereinafter referred to as "subject property").

The learned Government Advocate appearing for 1st respondent submitted that the petitioner submitted a Protest Petition dated 15.07.2025 before the 1st respondent requesting not to register any Sale Deed or any other Deed in respect of the subject property, but, the said Protest Petition is not in a proper format.

3.1. It is further submitted by the learned Government Advocate for 1st respondent that if the petitioner submits a Protest Petition in a proper format, 1st respondent would consider the same before proceeding to register any documents in respect of the subject property.

4. The above submission made by the learned Government Advocate for 1st respondent has been fairly conceded by the learned counsel for the petitioner.

5. In view thereof, this Court, without expressing any opinion on the merits of the case, issues the following directions: (i) The petitioner may submit a Protest Petition before the 1st respondent requesting not to register any Sale Deed or any other Deed in respect of the subject property, in a proper format. (ii) On submission of such Protest Petition by the petitioner, 1st respondent shall consider the same before proceeding to register any documents in respect of the subject property. 3/5

6. This Writ Petition is disposed of with the above directions. No costs. Consequently, connected Miscellaneous Petition is closed. 28.08.2025 mrr Index : Yes/No To The Sub Registrar, Registration Department, Thottipalayam, Tiruppur District.
