R. Jagan v. S.V.Jayakumar

CMP.No.20215/2022 in AS.No.101/2021 S.S.SUNDAR, J., and N.MALA, J., [Order of the Court was made by S.S.SUNDAR, J.,] This petition is filed to bring on record, the proposed respondent as the legal heir of the deceased/1st respondent as the 10th respondent in AS.No.101/2021.

2.In the affidavit filed in support of this petition, the petitioner has stated that the 1st respondent died leaving behind respondents 2 and 10 as his legal representatives. The 2nd respondent is already on record and therefore, this petition is filed to implead the proposed respondent as the 10th respondent who is none else than the wife of the deceased/1st respondent.

3.Though the learned counsel for the 1st respondent knew that the 1st respondent is no more, unfortunately, it is reported before this Court that she has no instructions from the proposed respondent.

4.This Court having regard to the facts and circumstances, is inclined to allow this petition. Accordingly, this Miscellaneous Petition is allowed.

5.Learned counsel for the 1st respondent is directed to inform the newly impleaded 10th respondent who is none else than the wife of the deceased / 1st respondent about the status of the case and the fact that the petition filed by the appellant to bring on record the 10th respondent as party to the proceedings as the legal representative of the deceased/1st respondent.
