JUDGMENT
(Judgment of the Court was made by N.SATHISH KUMAR, J.) Today the matter is listed the caption "For Settlement".
2. Ms.R.Sree Vidya, learned counsel for the appellant Insurance Company and Mr.V.S.Sivasundaram, learned counsel for the respondents are before this Court.
3. The learned counsel on both sides submit that the impugned award was passed for a sum of Rs.31,01,000/-, now they have arrived at a settlement and the respondents 1 to 3 have agreed to receive a sum of Rs.29,10,000/- (Twenty Nine Lakhs and Ten Thousand only) in full quit to the satisfaction of the award and the terms have been reduced to writing in the form of "Joint Memo".
4. The Joint Memo filed by the parties is taken on record and this Civil Miscellaneous Appeal is decreed in terms of the Joint Memo. The 2/4
Joint Memo shall form part of the decree. It is also submitted by both sides that at the time of admission of this appeal, the entire award amount of Rs.31,01,000/- was ordered to be deposited before the Tribunal as a condition for grant of stay. In such view of the matter, the respondents 1 to 3 are entitled to receive a sum of Rs.29,10,000/- only and remaining amount with accrued interest on the entire deposit shall be returned to the Insurance Company on filing of proper application before the Tribunal. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
