O R D E R

This petition has been filed seeking a direction to the second respondent to register the F.I.R. based on the petitioner's complaint dated 20.01.2022.

2. The petitioner, wife of Manikandan had lodged a complaint to the second respondent on 20.01.2022 making allegation against her husband and in-laws for demand of dowry and harassment. Though CSR was issued on 04.03.2022, thereafter no action has been taken. Hence the above petition.

3. Learned Additional Public Prosecutor submits that on the complaint of the petitioner, CSR was assigned on 22.03.2022 in CSR No.43 of 2022. The petitioner and counter petitioner in the complaint were summoned to the police station. They appeared before the police and at that time the petitioner's husband gave an undertaking that by 24.02.2022 he 2/6

would find a separate house and start live with the petitioner. In view of the above submission, no further action has been taken. After filing of this petition again the petitioner and counter petitioner were called for an enquiry and it was found that as per the undertaking earlier given, the petitioner's husband and in-laws, not resolved the dispute by having a separate home. Further it was found that the petitioner and her husband are not living together. During enquiry it was found that petitioner's husband and in-laws are restraining the petitioner's property and hence a case was registered in Crime No.11 of 2023 for offence under Section 498-A against Manikandan, her husband, Palanisamy, Muthulakshmi, Selvanayagi and Saravankumar, her in-laws. A copy of the F.I.R. has been produced. Further, the copy of F.I.R. has been handed over to the learned counsel for the petitioner.

4. In view of the above submission, this Court finds that on the complaint of the petitioner, a case has already been registered in Crime No.11 of 2023 for offence under Section 498-A I.P.C. In view of the same, no 3/6

further orders required in this Criminal Original Petition and the same is dismissed.
