Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondents to provide appointment to the petitioner on Compassionate Grounds based on the proposal forwarded by 3rd respondent in Na.Ka.No.A3/28479/2015 dated 04/08/2016 and on further proposal in Na.Ka.No.A3/28479/2015 dated 11/01/2017 within a time frame to be fixed by this Hon'ble Court. O R D E R

The prayer sought for in this Writ Petition is to direct the respondents to provide appointment to the petitioner on Compassionate Grounds based on the proposal forwarded by 3rd respondent in Na.Ka.No.A3/28479/2015 dated 04/08/2016 and on further proposal in Na.Ka.No.A3/28479/2015 dated 11/01/2017 within a time frame to be fixed by this Hon'ble Court.

2. The case of the petitioner is that his father was

employed in Tamil Nadu Police Service. On 28.06.2004, the father of the petitioner was died while in service, leaving behind the petitioner and his brother in lurch. The petitioner's mother predeceased his father in the year 2002. On 29.12.2004, the petitioner made a representation to the 3rd respondent. After several years, the application made by the petitioner was forwarded to the 2nd respondent and the same was rejected on the ground of certain compliances. On 04.08.2016, the 3rd respondent after compliance of the same forwarded the proposal to the 2nd respondent and the same was kept pending. Thereafter, the 3rd respondent sent a communication dated 11.01.2017, to the petitioner stating that the original proposal for his compassionate appointment was forwarded to the 1st respondent and after receipt of the same it will be forwarded to the 2nd respondent for providing compassionate appointment to him. However, the said proposal was not considered till date. Therefore the present Writ Petition has been filed.

3. The learned counsel for the petitioner would submit that it would be suffice to issue direction to the respondents to consider the proposal dated 04.08.2016 in accordance with law.

4. Considering the limited request made by the learned counsel for the petitioner, this Court hereby directs the respondents to consider and dispose of the proposal dated 04.08.2016, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

4. The Writ Petition is disposed of with the above direction. No costs.
