Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondents 1 to 7 herein to remove the encroachment made by the respondents 8 to 13 herein in Government Neervazhi Pattai Poromboke lands (Water way cum Pattai Promboke lands) in S.No.12 Chinnakappankulam Village, Virudhachalam Taluk, Cuddalore District, as per G.O.Ms.No.540 Revenue (L.D.6(2)) Department dated 04.12.2014 by invoking the provisions of Tamil Nadu Land Encroachment Act, 1905. ORDER

(Made by the Hon'ble Chief Justice) We heard Mr.P.Mani, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader assisted by Mr.Karthick Jaganath, learned Government Advocate for respondents 1 to 7.

2. Learned counsel for the petitioner submits that respondents 8 to 13 have encroached the Government Neervazhi Pattai Poromboke lands.

3. The matter is pending since the year 2017. The Authorities may conduct a survey, if the same is not conducted and depending upon the report of the survey, the Authorities shall take steps in accordance with law, in tune with the survey conducted, expeditiously.

4. With these observations, the writ petition is disposed of. There will be no order as to costs.
