Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to pass an order directing the 1st and 2nd respondent to deposit the Scholarship amount received in the 1st respondent Bank in an interest fetching fixed deposit in the name of the Registrar General of the Honourable Court in Indian Bank, Madras High Court Branch, Chennai in compliance of the order of this Honourable Court dated 27.8.2019 IN WMP.29502 OF 2019.
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.ARL.SUNDRASEN, SENIOR COUNSEL FOR MADHUMATHI, Advocate for the petitioner and of MR.V.KALYANARAMAN FOR M/S.AIYAR AND DOLIA, ADVOCATE FOR 1st Respondent and of MR. When it is pointed out that the relief claimed in this application travels beyond the scope of the relief sought in the Writ Petition itself and that the jurisdictional Debt Recovery Tribunal is seized of the matter, Learned Counsel for the Petitioner seeks permission of this Court to withdraw this Miscellaneous Petition with liberty to file an application in O.A. No. 496 of 2016 on the file of the Debt Recovery Tribunal-II, Chennai for necessary relief and he has made an endorsement to that effect.

Recording the same, this Miscellaneous Petition is dismissed as withdrawn granting such liberty. If such application is filed by 18.10.2019, the Debt Recovery Tribunal shall endeavour to take up the matter expeditiously, preferably by 21.10.2019.
