The petitioner, who apprehends arrest at the hands of the respondent Police for the offences under Sections 147, 341, 353 and 506(i) IPC in Crime No.244 of 2023 seeks anticipatory bail.

2. The learned counsel for the petitioner stated that the petitioner is an innocent person and he has been falsely implicated for the offences under Sections 147, 341, 353 and 506(i) IPC in Crime No.244 of 2023 in Crime No.244 of 2023. Thus, he seeks anticipatory bail to the petitioner.

3. It is stated by the learned Government Advocate (Crl.Side) that the defacto complainant is the Motor Vehicle Inspector. He had conducted vehicle check up at Manniivakkam. The petitioner was driver of the lorry bearing No.TN 19 AY 4036, which was overloaded with blue metals. A check report was raised by the defacto complainant and a sum of Rs.68,000/- was charged and E-challan was also issued. After about 20 minutes, the petitioner along with other accused came to the spot and threatened the defacto complainant. Thus, he prayed for dismissal of this petition. 1/4

4. The learned counsel for the petitioner stated that the complaint had been lodged after considerable delay. That issue can be examined only at the time of the trial.

5. Taking into consideration the nature of the offence, more particularly, the fact that the petitioner had objected the defacto complainant from performing his public duty, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
