The suit has been filed for specific performance of the agreement and in the alternative for recovery of money.

The agreement dated 28.09.2022 has been entered into at Chennai.

The respondent/defendant alone is having its office at Bangalore, outside the jurisdiction of this Court.

As seen from the averments contained in the plaint as well as in the affidavit filed in support of this application, major part of the cause of action arose only within the jurisdiction of this Court. The applicant/plaintiff seeks to grant leave to institute the suit against the respondent/defendant.

Since major part of the cause of action has arisen within the jurisdiction of this Court, this Court is inclined to grant leave to institute the suit. Accordingly, this application is allowed as prayed for. Registry is directed to number the suit if it is otherwise in order.
