(Order of the Court was made by S.M.SUBRAMANIAM,J.,) The counter affidavit filed by the Divisional Engineer, Department of Highways, Coimbatore would show that the petitioner assumed that his private land in S.F.No.260/1 was encroached by the temple Authorities. If it is an encroachment in private land, the aggrieved person has to approach the competent civil Court of law.

2. However, the learned counsel for the petitioner would submit that certain portion of the public land is also under encroachment.

3. In this regard, the Divisional Engineer has stated that the complaint submitted by the petition is vague. Thus, the petitioner is at liberty to submit a fresh complaint along with the details regarding encroachments to the Authorities and on receipt of any such fresh complaint, the Authorities are bound to look into the same and initiate all appropriate actions in the manner known to law.

4. With the above direction, this Writ Petition is disposed of. No costs.
