ORDER

The suit has been filed as rolled-up action for infringement and passing off. The plaintiff seeks joinder by this application. The plaintiff complains of alleged infringement and passing off by use of the mark/name SRI AACHI MESS.

2. Considering the nature of the suit, it is in the interest of justice to permit joinder so as to avoid multiplicity of proceedings. The respondent has failed to enter appearance and contest the application in spite of service of notice. Therefore, this application is allowed as prayed for.
