CMP.Nos.23420, 23422, 23423 & 23425 of 2023 in S.A.No.1095 of 2011 G.ARUL MURUGAN,J These petitions are filed by the petitioners seeking (i) to condone the delay of 431 days in filing the petition to set aside the abatement caused due to the death of both the first petitioner and the sole respondent during the pendency of the second appeal; (ii) to set aside the abatement caused; and (iii) to bring on record the legal heirs of the deceased 1st petitioner and the sole respondent.

2. It is not in dispute that the three out of four of the legal heirs of the deceased first petitioner are already on record, that only one person namely Mrs.L.Narasamma is to be brought on record and that the wife of the sole respondent also died during the pendency of the second appeal.

3. Considering the facts and circumstances of this case, these petitions are ordered.
