Writ Petition is filed for a writ of mandamus, seeking directions to the respondents to notify the application of the petitioner dated 29.05.2025, and grant permit to the petitioner on the route Senniandavarkoil to Pappampatti.
2. The case of the petitioner is that the Government of Tamil Nadu issued a notification in G.O.Ms.No.33 (Tr-1), dated 24.01.2025, which was subsequently modified by another notification in G.O.Ms.No.198, Home (Tr-1), dated 28.04.2025, expanding the mini bus scheme introduced in the year 1998. The said notification permitted existing minibus operators to migrate their existing permits. Pursuant thereto, the petitioner submitted an application 29.05.2025, to the 2nd respondent seeking a permit for the route Senniandavarkoil to Pappampatti. The 2nd respondent processed the said application and thereafter directed the Motor Vehicle Inspector, to survey the route along with other Departmental Officials and to submit a report. The Motor Vehicle Inspector, upon satisfaction of compliance with the prescribed norms, submitted a report to the 2nd respondent. However, thereafter no further action was taken and therefore aggrieved by such inaction, the petitioner has
approached this Court.
3. Learned counsel for the petitioner submitted that despite a favourable report from the Motor Vehicle Inspector, the 2nd respondent has not issued any notification for grant of permit. The learned counsel further submitted that in similar cases, the respondents had issued notifications granting permits, and therefore, the petitioner was entitled to same relief.
4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents. Perused the materials available on record.
5. The facts are undisputed. The petitioner's grievance is despite a favourable report by the Motor Vehicle Inspector, the 2nd respondent, has not taken further action. The records reveal that in similar cases, the respondents considered the applications and issued notification granting permits.
6. In view of the facts and circumstances of the case, this Court deems it appropriate to direct the 2nd respondent to consider the petitioner's application and pass appropriate orders within a time frame.
7. Accordingly, the 2nd respondent is directed to consider the petitioner's application dated 29.05.2025, in the light of the report dated 03.07.2025, of the Motor Vehicle Inspector and pass orders on merits and in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.
8. With the above directions, the writ petition is disposed of. There shall be no order as to costs.
