The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 12 of Protection of Child from Sexual Offences Act (POCSO), 2012 and Sections 67(B)(h) and 67A of the Information Technology Act, 2000 in Crime No.07 of 2023 seeks anticipatory bail.
2. The learned counsel for the petitioner stated that the petitioner is an innocent person and he had never done any of the acts as alleged by the respondent.
3. The learned Government Advocate (Criminal Side) stated that the defacto complainant had preferred Crl.O.P.No.22386 of 2023 and a learned Single Judge of this Court, in view of the gravity and nature of the offence had directed that the investigation to be transferred to the Cyber Crime Cell by an order dated 03.10.2023.
4. In view of that particular fact, the present anticipatory bail will not lie. Accordingly, this Criminal Original Petition is dismissed. 06.11.2023 mkn2/sli
