ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.07.2025, for the offence punishable under Section 24 (1) of the Cigarettes and other Tobacco Products Act, 2003, and Section 123 of the BNS, 2023, in Crime No.226 of 2025, registered on the file of the respondent, seeks bail.

2.The case of the prosecution is that, the petitioner along with other accused was found in

illegal possession of 3 kgs of banned Tobacco products. Hence, the case. 3.The learned counsel for the petitioner submits that the petitioner is an innocent person who has been falsely implicated in this case by the respondent Police. He also submits that the petitioner has been in judicial custody from 25.07.2025. Hence, prays for grant of bail to the petitioner.

4.The learned Government Advocate (Criminal side) appearing for the respondent Police submits that a cash amount of Rs.29,000 and 1.520kg of Tobacco products was recovered from the petitioner, which is alleged to be the proceeds of selling banned tobacco products. Since, the investigation is still pending, the release of the petitioner may tamper with the evidence and there is every possibility of abscondence. Hence, strongly opposed for grant of bail to the petitioner.

5.Heard the learned counsels on either side and perused the records. 6.Considering the nature of the offence, the fact that the investigation is still pending, and since the custodial interrogation of the petitioner is very much required, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition stands dismissed.
