ORDER
This writ petition has been filed praying to issue a writ of mandamus directing the first respondent to consider and pass orders on the representation dated 29.05.2025 submitted with regard to payment of statutory interest for the belated payment of the retiral benefits of Rs.1,05,349 (Earned Leave, Unearned leave) as per Rule 45(1-A) of the Tamil Nadu Pension Rule 1978 for the period from 30.6.2022 to 19.11.2024 and to pay interest Rs.1,01,225/- as D.C.R.G Amount for the period from 30.06.2022 to 18.12.2024 as at the rate of 12% compoundable interest as per G.O.Ms.No.517 Finance (Pension) Department dated 12.6.1987 and G.O.Ms.No. 122 Finance (Pension) Department dated 20.2.1995. 2.
The case of the petitioner is that he was initially appointed as Field Development Officer on 29.03.1996 and was subsequently promoted as Assistant Agricultural Officer. He was permitted to retire on 30.06.2002, while withholding some retiral benefits such as Earned Leave / Unearned Leave & DCRG amount. Challenging the order withholding the retiral benefits, W.P.No. 831 2/5
of 2014 was filed by the petitioner and the same was allowed on 10.06.2022 with a direction to the respondents to pay all the benefits to the petitioner. Though a representation was submitted by the petitioner, the same did not educe any response. Hence, the petitioner has filed this writ petition.

Mr.Yogesh Kannadasan, learned Special Government Pleader, would submit that the prayer in the present writ petition has already been raised in W.P.No. 831 of 2014 and the same was allowed on 10.06.2022. He further submits that the present writ petition itself is not maintainable and is liable to be dismissed. 4.
Heard both sides.

Though a larger relief has been sought by the petitioner, this Court is of the view that it is suffice to direct the first respondent to consider the representation dated 29.05.2025, and pass orders on its own merits and in accordance with law, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order, keeping in mind the earlier order dated 10.06.2022 in W.P.No.831 of 2014. It is made clear that this Court has not expressed any opinion on the merits of the claim 3/5
made by the petitioner.

This writ petition stands disposed of accordingly. No costs.
