PRAYER : Criminal Original Petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the petitioner on bai in Crime No.15/2025/AC/CB on the file of the respondent police. ORDER

The petitioner, who was arrested and remanded to judicial custody on 26.07.2025, for the offences punishable under Sections 7(a) of Prevention of Corruption Act, 1988 in Crime No.15/2025/AC/CB on the file of the respondent police, seeks bail.

2. The case of the prosecution as per the defacto complainant is that petitioner, who is working as Office Assistant under Tahsildar/A1, who is alleged to have asked bribe amount of Rs.50,000/- from the defacto complainant for issuance of solvency certificate. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence, however, he is suffering incarceration from 26.07.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.side) appearing for the respondent police submitted that A1 demanded a bribe amount of Rs.50,000/- from the defacto complainant. Hence, a complaint has been lodged and the respondent Page No.2/4

conducted the trap and the petitioner/A2 caught red-handed on his receipt of bribe amount of Rs.50,000/- on behalf of Tahsildar/A1. Hence, he strongly opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the above facts and circumstances of the case and taking note of the submission made by the learned Government Advocate (Criminal Side) that the petitioner has received the bribe money on behalf of the Tahsildar, this Court is not inclined to grant bail to the petitioner.
