The Criminal Original Petition has been filed seeking a direction to the first and second respondent Police not to harass the petitioner under the guise of investigation/enquiry.

It is the grievance of the petitioner that under the pretext of enquiry, the respondent Police are unnecessarily harassing the petitioner and his family members.

The learned Government Advocate (Criminal Side), on instructions, submitted that on the complaint given by the de facto complaint with regard to the job racketing, notice has been issued to the petitioner for enquiry.

In such circumstances, it is for the Investigating Agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioner shall appear for enquiry and co-operate with the investigation. If any cognizable offence is made out, the respondent shall register the First Information Report and proceed as per law.

5. Accordingly, this Criminal Original Petition stands disposed of with the aforesaid direction.
