This Criminal Original Petition has been filed for directing the third respondent to alter the FIR No.271 of 2019 dated 08.09.2019 and include under Section 307 of IPC on the file of final report before Competent Court, within a stipulated time.
2. The grievance of the petitioner is that the injuries sustained by her are multiple injuries and such offence under Section 307 of IPC would be attracted. Hence, the petitioner has https://hcservices.ecourts.gov.in/hcservices/
sought for a direction for alteration of the offence in FIR.No. 217 of 2019. It is seen that the investigation is still pending and the charge sheet is yet to be filed. At this juncture, it would not be appropriate to direct the third respondent police to alter the offence which is subject matter of the investigation. Nevertheless, if the third respondent is directed to complete the investigation within a stipulated time, with liberty to the petitioner to challenge the charge sheet, if any, the ends of justice could be secured.
3. In the light of the above observations, there shall be a direction to the third respondent to complete the investigation in FIR.No.217 of 2019 dated 08.09.2019 within a period of eight
(8) weeks from the date of receipt of a copy of this order. Accordingly, the Criminal Original Petition is disposed of.
