The petitioner, who was arrested on 08.08.2023 and remanded to judicial custody on 09.08.2023 for the offences punishable under Sections 302 IPC @ 147, 148 and 302 IPC in Crime No.380 of 2023 on the file of the respondent police, seeks bail.

2.The learned counsel for the petitioner submitted that the petitioner is a Railway Khalasi and stated that his vehicle had been stolen, however, no FIR had been registered by the petitioner herein for the loss or theft of the vehicle. He is an innocent person and he has been falsely roped into the case. Thus, prayed for grant of bail to the petitioner. 3.It is stated by the learned Government Advocate (Criminal Side) that the complaint was lodged by the defacto complainant and the deceased is the sister's son of defacto complainant. It had been stated by the respondent that the deceased and the 1st accused had dispute over selling of Ganja and in that dispute, it was stated that the deceased had abused the wife of 1st accused and therefore, 1st accused had engaged other persons. It is further stated on the side of the respondent that there are totally nine accused, who are still in 1/3

custody and the investigation is yet to be completed. Hence, he prayed for dismissal of this petition.

4.Considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Let the investigation be completed. Accordingly, this Criminal Original Petition stands dismissed. 09.10.2023 mkn2/sli 2/3
