ORDER

This Criminal Original Petition has been filed to direct the Principal District and Sessions Court at Kancheepuram to dispose of the C.A.No.36 of 2024 within a time frame and thus render justice.

2. The petitioner filed a private complaint against the respondent for the offence under section 138 of the Negotiable Instruments Act. The respondent was convicted for the offence under section 138 of the Negotiable Instruments Act and by the judgment dated 02.07.2024 and he was sentenced to under go simple imprisonment for six months and to pay compensation of Rs.11,42,000/- in default to undergo simple imprisonment for three months. As against which the respondent had filed an appeal in C.A.No.36 of 2024. The grievance of the petitioner is that though he was cheated in the year 2019 and respondent was convicted in the year 2023, he was not able to realise the money borrowed by the respondent. Hence seeks a direction for early disposal of the appeal filed by the respondent.

3. Considering the submissions of the petitioner and taking note of the facts and circumstances of the case, the learned Principal District and Sessions Judge, Kancheepuram is directed to dispose of the appeal in C.A.No.36 of 2024 expeditiously.

4. With the above direction, this Criminal Original Petition is disposed of.
