in Crl.A.No.65 of 2019 P.N.PRAKASH.J., AND N.ANAND VENKATESH.J., [Order of the Court was made by P.N.PRAKASH.J.,] This Criminal Miscellaneous Petition has been filed seeking interim bail to the petitioner/A4 for one month pending disposal of the Criminal Appeal in Crl.A.No.65 of 2019 on the ground that his wife is suffering from cancer.
2. The petitioner was convicted and sentenced by the learned Sessions Judge (Mahila Court), Cuddalore, by judgment dated 04.01.2019 in Spl.S.C.No.20 of 2018 as under:- Accused Provision under which convicted Sentenced to Rigorous Imprisonment for 30 (thirty) years and to pay a fine of Rs.5,00,000/- (Rupees Five Lakhs only) and in default of payment of fine, to suffer simple imprisonment for 5 (five) years.

3. Heard Mr.R.Sankarasubbu, learned counsel for the petitioner and Mr.R.Muniyapparaj, learned Additional Public Prosecutor for the respondent/State.
4. This court called for the report from the hospital which shows that wife of the petitioner has undergone treatment for breast cancer in the last six months and also undergone mastectomy and she has also completed her course of chemotherapy and radiotherapy and at present, her condition appears to be stable.
5. Taking into consideration the nature of the allegations in the matter, being a case under the POCSO Act, we are not inclined to grant interim bail to the petitioner. This Miscellaneous Petition is dismissed accordingly. [P.N.P., J] [N.A.V.,J.] 14..12..2022 kmk
